  • Prosecutors seeking to admit evidence of computer crimes face two primary hurdles: authenticating the records and overcoming hearsay objections. First, the Federal Rules of Evidence mandate that before a record can be moved into evidence, "the proponent must produce evidence sufficient to support a finding that the item is what the proponent claims it is. Second, hearsay is "a statement that ... the declarant does not make while testifying at the current trial or hearing ... and ... a party offers in evidence to prove the truth of the matter asserted in the statement. Although computer records that involve an assertion by a person have been admitted under the business records exception,48' courts have recently begun to distinguish between different types of computer records. These courts have been reluctant to apply the business records exception to certain emails, chats, and social media messages.
