  • The United States has pressed for a strong international response to the extensive brutal attacks on civilians in the Darfur region in western Sudan. In congressional testimony in September 2004, Secretary of State Colin Powell characterized events there as genocide, and the United States was instrumental in the creation of a high-level UN Commission of Inquiry to investigate events in Darfur, including whether genocide had occurred. The commission, chaired by Antonio Cassese, former president of the International Criminal Tribunal for the Former Yugoslavia and a prominent supporter of the International Criminal Court (ICC), presented its 176-page report in late January 2005. The commission found that Sudanese government forces and militias have conducted indiscriminate attacks in Darfur, including mass killings, torture, rapes, and forced displacement of civilians, but it did not find the government to be responsible for genocide, because it lacked the requisite intent "to destroy, in whole or in part, a national, ethnical, racial or religious group, as such." The commission did conclude, however, that crimes against humanity and war crimes had occurred, and strongly recommended.
