  • The World Health Organization (WHO) emphasizes universal health coverage as a primary aim for all countries. The rights-based approach serves as a normative framework for universal health coverage.1 This approach contends that health is a human right-the right to the highest attainable standard of health-and that any individual can claim this right against others; and governments, constituted by these individual "others," have the duties to fulfill and protect the full exercise of this right. The right to health is also enshrined internationally via covenants such as the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the Universal Declaration of Human Rights.Despite these ethical and legal underpinnings, populations in partially recognized states and disputed territories lack global protections to their right to health. In this editorial, we highlight the experience ofthese populations while confronting a unique challenge: the inconsistency between de facto and de jure protection of the right to health. This inconsistency merits specific attention, from both normative and practical policy perspectives, because it creates a gap in the global defense of human rights and in the global pursuit of universal health coverage. We use the experience of Taiwan to draw attention to this inconsistency.
