In Gerhard Kobler v. Republik Osterreich, the European Court of Justice (ECJ) declared, for the first time, the possibility of Member State liability for decisions of national courts adjudicating at last instance. The case itself concerned the conditions under which the State may grant employees in public service a 'loyalty bonus' without violating the principle of free movement of workers.
