• This article deals with the effects of the fundamental right of freedom of conscience in criminal law issues. The different doctrinal approaches towards the freedom of conscience in criminal law are analyzed: by way of a cause of justification, excuse or mitigating. In addition are developed new arguments in favour of a possible excuse owing to an absence of preventive need for punishment (Entschuldigung beim Fehlen einer praventiven Bestrafungsnotwendigkeit) and this opinion is opposed to Figueiredo Dias's and Frisch's approaches.
