The rationale for including a human rights-based approach in the field of tobacco control has been well-argued by many.[1-5] These justifications predominantly state that: 1) the human right to tobacco control emerges from the right to life and the right to health, as outlined in international human rights treaties; and 2) because tobacco use is the largest cause of preventable death in the world, its control is essential for the realization of these rights.[2] The World Health Organization's (WHO) Framework Convention on Tobacco Control (FCTC), itself a derivative of previous international human rights treaties,[1] cites these treaties in its preamble, and reaffirms the 'right of all people to the highest standard of health' while calling for Parties to 'give priority to their right to protect public health.'[6]
