Digital communications afforded by the internet, mobile smartphones, and Wi-Fi enabled devices, have become part of everyday life. By dramatically improving access to information and real-time communication, innovations in communications technology have boosted freedom of expression, facilitated global debate, and fostered democratic participation.1 In this digital era, communication technology has also enhanced the capacity of governments, enterprises and individuals to conduct surveillance, and intercept and collate data.2 This phenomenon rightly raises concern about unwarranted intrusion into the right to privacy of individuals, companies, and other entities. By all accounts, the right to privacy has to do with delineating the legitimate limits of governmental power.
