During the ten plus years of rapid development of franchise in China, the legal system of franchise was establishing and developing. However, currently, there is still no civil law or commercial law on franchise contract, except for administrative regulations, which is too simple and somewhat impracticable. Especially terminating franchise contract, which more and more disputes arising from, has no particular regulations. It puts the court handling the related lawsuits in a dilemma. Therefore, it is important both theoretically and realistically as to the healthy development of franchise in China to strengthen the research on the theory and the law on franchise contract, especially franchise contract termination.
