• This chapter provides an overview of existing IP laws and institutions in Africa together with their historical development and highlights the most recent developments. It introduces the concept of the public interest in IP, as conceptualised at global, regional, sub-regional and national levels, whilst highlighting African states' unique challenges with an emphasis on the diversity of circumstances across the continent. It argues that this setting merits appropriately nuanced IP frameworks and equally malleable harmonisation models. Accordingly, it considers African states' contribution to the articulation and formulation of the Development Agenda at the World IP Organisation, and their experience of TRIPS implementation. Given the primacy of healthcare needs in Africa, it then highlights the continental IP policy focus on TRIPS health-related flexibilities and ends with a preview of ongoing work on nuancing IP systems on the continent.
