• This chapter explains the different ways in which legal certainty has been conceptualized in the context of EU law. In the first instance, it fleshes out the basic tenets of the principle of legal certainty and provides an account of its different manifestations and contexts in the Court’s case law. In the second instance, the chapter addresses the more theoretical underpinnings of legal certainty keeping in mind the theoretical division between formal and substantive legal certainty.
