- “We do not accept Mrs. Cohen’s premise that the regulation’s provision which denies her, with the advice of her doctor, the right to decide when her maternity leave will begin is an insidious classification based upon sex,” declared Judge Clement Haynsworth of the Fourth Circuit in a 1973 decision. A high school social studies teacher, Susan Cohen had challenged a compulsory pregnancy leave imposed on her by her school board in Virginia. The forced leave was sex discrimination, Cohen claimed, and violated her Fourteenth Amendment rights. A bare majority of the circuit court joined Judge Haynsworth to reject her claim
