  • This article discusses the scope of the power of a 'magistrate' under the Code of Criminal Procedure. Specifically, the article argues that the widely held belief and the dicta of the Supreme Court in Sundeep Kumar Bafna v. State of Maharashtra (2014) 16 SCC 623 that the Magistrate is not empowered to grant bail in cases involving offences punishable by death or imprisonment for life is not correct. The author discusses whether the approach of accused to simply 'appear' before the High Court at the time of hearing bail application under Section 439 of the Code of Criminal Procedure, 1973 can be treated as a legally correct approach. It is argued that even a Magistrate is empowered to grant bail in 'serious offences', and urges that such power should be highlighted and must be exercised to prevent avoidable pre-trial detention and docket-explosion at Sessions Court and the High Court.
