  • This chapter discusses biodiversity conservation and sustainable use of genetic resources in habitats particularly in need of international legal protection – namely marine resources found in Areas Beyond National Jurisdiction (ABNJ). It describes the United Nations Convention on the Law of the Sea (UNCLOS) as the cornerstone of the current legal framework concerned with the protection and use of marine biodiversity in areas beyond national jurisdiction. The chapter then outlines the ongoing process of negotiation at the United Nations towards a new Internationally Binding Legal Instrument (IBLI) for biodiversity in ABNJ. The 1970 Convention on Migratory Species (CMS) focuses first on the protection of endangered migratory species for which Range States have an obligation to conserve and restore the habitat of these species and to limit and mitigate potential impacts to migratory corridors. A challenge in the protection and sustainable use of marine biological diversity is the threat posed by illegal trade in wildlife.
