• O Estado nem sempre foi uma realidade para os individuos. Em torno de sua criacao, existem numerosas teorias, sendo adotadas as desenvolvidas por Thomas Hobbes e Piotr Kropotkin. O artigo visa realizar estudo comparativo sobre a criacao do Estado, se esta se deu em funcao da fuga da guerra ou por meio da colaboracao; outrossim, buscar-se-a abordar como ocorre o efetivo acesso a justica por meio da litigancia ou da colaboracao. Sera utilizado o metodo de abordagem dedutivo, partindo de uma analise geral da criacao do Estado, chegando a uma especifica que e a utilizacao da colaboracao para tratar demandas conflitivas. Como tecnica de pesquisa, a bibliografica, que, ao final, permite esclarecer que, no que tange a resolucao de conflitos, nao e necessario fazer a guerra para encontrar a paz (teoria hobbesiana) e que os conflitos podem ser tratados de maneira colaborativa (Kropotkeniana), utilizando-se de ferramentas adequadas. Palavras-chave: Colaboracao; Estado; guerra; Jurisdicao; litigancia. The State has not always been a reality for individuals. Around its creation, there are numerous theories, being adopted those developed by Thomas Hobbes and Piotr Kropotkin. The article aims to carry out a comparative study on the creation of the State, whether it was due to the flight from the war or through collaboration; in addition, we will seek to address how effective access to justice occurs through litigation or collaboration. The deductive method of approach will be used, starting from a general analysis of the creation of the State, reaching a specific one that is the use of collaboration to deal with conflicting demands. As a research technique, the bibliography, which, in the end, makes it possible to clarify that, with regard to conflict resolution, it is not necessary to make war to find peace (Hobbesian theory) and that conflicts can be dealt with in a collaborative way ( Kropotkeniana), using appropriate tools.
