  • This study presents a critical analysis of Extraordinary Writ 601.392/PR, in which the trial highlights legal and interpretative protection of the monopoly of the Brazilian Company of Post and Telegraphs, known as ECT. The appeal dealt with the extension of reciprocal immunity to services performed by ECT, which are not encompassed in the exclusive postal service. To describe the methodology, this article applied a qualitative and descriptive research with and inductive method. This investigation demonstrates critics from the analysis of the votes that led to the trial, through the constitutional, regulatory theory and competition law viewpoint. The hypothesis is based on the fact that there is no need to maintain the monopoly in the postal service. Also, the decisions only favor ECT. Thus, the Supreme Court (STF) refrains from giving a proper understanding for the constitutional guideline of the economic order, allying with regulation and free competition theory, protecting ECT to the detriment of Brazilian society.
