• The purpose of this article is to analyze the transport of persons in the cargo compartment (trunk) of police vehicles, whether they are arrested in flagrante delicto or by written order of the judicial authority. It will analyze the Brazilian legal system and its ability to specify the constitutional norms of the dignity of the human person described in the Federal Constitution and infraconstitutional legislation from the perspective of the Criminal Guarantor. In addition, it will analyze the action of the control bodies of the Public Administration in relation to this legal fact regarding the possibility of abuse of power in the transportation of people in the cargo compartment. Este artículo tiene por objeto analizar el transporte de personas en el compartimiento de carga (maletero) de vehículos policiales, sean presas en flagrante delito o por orden escrito de la autoridad judicial. Se analizará el ordenamiento jurídico brasileño y su capacidad para concretar las normas constitucionales de la dignidad de la persona humana descritas en la Constitución Federal y legislación infraconstitucional desde una perspectiva del Garantismo Penal. Además, se analizará la actuación de los órganos de control de la Administración Pública en relación a este hecho jurídico en cuanto a la posibilidad de abuso de poder en el transporte de personas en el compartimiento de carga realizadas por las policías en Brasil.
