  • This book aims to explore the systems which are set within the Economic Constitution for holding the executive to account when it uses public money in Public-Private Partnerships (PPPs) in the UK and the USA. The specific point of focus in the exploration of these systems is the criteria of accountability. In the UK, a clear and well-established constitutional principle requiring the enactment of legislation for implementing systems and criteria of accountability for PPPs does not seem to exist. The predominant system of accountability for PPPs is the default system designed for all financial matters. We propose that the UK Economic Constitution for PPPs should recognise the need for legislation for every PPP sector, and that there exists the need for affirmative resolution procedure for every new PPP project. In the USA, legislation is generally recognised as constitutionally necessary for the authorisation of the government to use PPPs and for the setting of criteria and accountability arrangements for them. There is, however, no general system of accountability for all PPPs. Instead, accountability is based on the many criteria that the many laws provide. We propose that the Economic Constitution for PPPs should recognise that there is a positive governmental duty to systematise these criteria. The underlying framework of the analysis is one of seeking an appropriate balance between effectiveness and accountability for PPPs in the Economic Constitution.
